Stardate Candles Gift Card Terms and Conditions

These Gift Card Terms and Conditions (Gift Card Terms) apply to the purchase, redemption, and use of gift cards issued by JJAK Pty Ltd t/a Stardate Candles (ABN 80 654 590 744) (Stardate Candles, we, our or us) through the website stardateco.com.au (Website).

These Gift Card Terms supplement, and should be read together with, our Terms of Service, Privacy Policy, Refund Policy, and 30-Day Money Back Guarantee, each available on our Website. Where there is any inconsistency between these Gift Card Terms and our Terms of Service in relation to gift cards, these Gift Card Terms prevail.

By purchasing, receiving, or redeeming a Stardate Candles gift card, you acknowledge that you have read, understood, and agreed to be bound by these Gift Card Terms.

1. About Stardate Candles Gift Cards

1.1. A Stardate Candles gift card (Gift Card) is a digital gift card that can be redeemed for products available on our Website, subject to these Gift Card Terms.

1.2. Gift Cards are available for purchase in the following denominations: AUD $100, $150, $200, and $300. All Gift Card values are in Australian Dollars (AUD).

1.3. Gift Cards are issued and delivered electronically by email. We do not issue physical gift cards.

1.4. Gift Cards are issued and managed through the Shopify platform that hosts our Website.

2. Purchase

2.1. Gift Cards may be purchased through our Website by any person aged 18 years or older with the legal capacity to enter into a contract.

2.2. Gift Cards may be purchased by customers located outside Australia for delivery to recipients located in Australia. However, products purchased using a Gift Card can only be shipped within Australia, as Stardate Candles does not currently ship internationally.

2.3. Payment for Gift Cards must be made in full at the time of purchase using a payment method accepted on our Website.

2.4. Once payment is processed, a Gift Card will be issued and delivered electronically to the email address provided by the purchaser at checkout.

2.5. We reserve the right to refuse, cancel, or limit any Gift Card purchase at our sole discretion, including where we suspect fraud, misrepresentation, or breach of these Gift Card Terms.

3. Delivery

3.1. Gift Cards are typically delivered within minutes of successful payment processing. In rare cases, delivery may be delayed due to email service provider issues, spam filters, or other technical factors outside our control.

3.2. It is the purchaser's responsibility to provide an accurate email address at the time of purchase. We are not responsible for Gift Cards delivered to an incorrect or inaccessible email address as a result of information provided by the purchaser.

3.3. If a Gift Card has not been received within a reasonable time, the purchaser should first check spam and junk folders before contacting us at support@stardateco.com.au.

3.4. The purchaser is responsible for forwarding the Gift Card to the intended recipient if the Gift Card is purchased as a gift.

4. Validity and Expiry

4.1. Gift Cards are valid for three (3) years from the date of issue.

4.2. The expiry date of each Gift Card is displayed on the Gift Card itself and in the Gift Card delivery email.

4.3. Gift Cards that have expired cannot be redeemed, reinstated, or exchanged for cash, store credit, or a replacement Gift Card.

4.4. It is the responsibility of the Gift Card holder to redeem the Gift Card before its expiry date.

5. Redemption

5.1. Gift Cards may be redeemed only on our Website (stardateco.com.au) at checkout by entering the Gift Card code in the designated field.

5.2. Gift Cards may be used to purchase any product available on our Website, including products on sale, promotional products, and bundled products.

5.3. Gift Cards may be used in conjunction with other discount codes, promotional offers, and free shipping offers, unless the specific terms of a promotion state otherwise.

5.4. Up to three (3) Gift Cards may be applied to a single order. We reserve the right to refuse, at our sole discretion, the application of additional Gift Cards beyond this limit.

5.5. Gift Cards can be used to pay for shipping costs, taxes, and any other charges applicable to an order.

5.6. If the value of an order exceeds the available balance on the Gift Card(s) applied, the remaining balance must be paid using another accepted payment method at checkout.

5.7. If the value of an order is less than the available balance on the Gift Card, the remaining balance will stay on the Gift Card and may be used for future purchases until the Gift Card's expiry date.

5.8. Gift Cards cannot be redeemed for cash, exchanged for store credit (other than as expressly provided in these Gift Card Terms), or used to purchase additional Gift Cards.

5.9. Gift Cards cannot be redeemed at any third-party retailer, marketplace, or platform other than our Website.

6. No Refunds on Gift Cards

6.1. Gift Cards are non-refundable. Once a Gift Card has been issued, the purchase cannot be cancelled or refunded, except where required by Australian law.

6.2. This clause does not affect any rights you may have under the Australian Consumer Law in respect of a Gift Card that is faulty, has not been delivered due to our error, or has otherwise not been supplied as described. In such cases, please contact us at support@stardateco.com.au.

7. Refunds and Returns of Products Purchased with a Gift Card

7.1. Where a product purchased using a Gift Card is returned in accordance with our Refund Policy or 30-Day Money Back Guarantee, any refund will be issued as a re-credit to the original Gift Card used to make the purchase, restoring the corresponding balance.

7.2. Refunds for change-of-mind returns are subject to our standard returns policy, which includes the following:

(a) the customer is responsible for return shipping costs;

(b) products that are damaged, used, or not in their original saleable condition may not be eligible for a refund;

(c) certain products are excluded from change-of-mind returns, including (but not limited to) Gift Cards, custom gift wrapping services, Stardate Miniature 35g Candles, custom orders, bulk orders, final sale items, discontinued products, and promotional or gifted items;

(d) where a returned product was purchased as part of an order to which a Gift Card was partially applied, the refund will be apportioned between the Gift Card and the original payment method based on the proportion paid by each.

7.3. Damaged products are handled separately under our Refund Policy and 30-Day Money Back Guarantee, which may entitle the customer to a direct replacement or refund where the product is found to be damaged or faulty.

7.4. Where a Gift Card balance is restored as a result of a refund, the restored balance will retain the original expiry date of the Gift Card and will not be extended.

8. Lost or Stolen Gift Cards

8.1. Gift Cards should be treated like cash. We are not responsible for Gift Cards that are lost, stolen, damaged, deleted, or used without the Gift Card holder's permission once they have been delivered to the email address provided at the time of purchase.

8.2. We will not replace, reissue, or refund any Gift Card that is lost, stolen, or used without authorisation.

8.3. If a Gift Card is suspected to have been compromised, the purchaser or recipient should contact us immediately at support@stardateco.com.au. We may, at our sole discretion and where reasonably possible, assist in identifying any unauthorised redemption, but we are under no obligation to do so or to provide any remedy.

9. Fraud and Misuse

9.1. We reserve the right to void, cancel, or disable any Gift Card, with or without notice, where we reasonably believe that:

(a) the Gift Card was purchased using a fraudulent, unauthorised, or invalid payment method;

(b) the original payment for the Gift Card has been reversed, charged back, or refunded;

(c) the Gift Card has been obtained or used in breach of these Gift Card Terms or any applicable law;

(d) the Gift Card is being used in connection with fraudulent activity or attempted fraud; or

(e) the Gift Card has been resold, transferred, or distributed in breach of clause 10.

9.2. Where a Gift Card is voided under this clause, any balance remaining on the Gift Card will be forfeited and we will not be liable for any loss suffered by the holder, the purchaser, or any third party.

10. Resale and Transfer Prohibited

10.1. Gift Cards are intended for personal use as a gift or for the purchaser's own use. Gift Cards must not be resold, traded, auctioned, or otherwise transferred for value through any third-party marketplace, secondary platform, or commercial means.

10.2. Gift Cards obtained through unauthorised resale, secondary marketplaces, or other prohibited channels may be voided at our sole discretion under clause 9.

10.3. Gift Cards may be given as a gift to another person, free of charge, by the original purchaser. This is not considered a resale or transfer for value.

11. Post-Supply Fees

11.1. In accordance with Australian Consumer Law, no fees or charges will be applied to a Gift Card after it has been purchased. This includes activation fees, account-keeping fees, balance enquiry fees, and inactivity fees.

12. Changes to Gift Card Terms

12.1. We reserve the right to amend, modify, or update these Gift Card Terms at any time by posting the updated terms on our Website.

12.2. Any changes to these Gift Card Terms will apply to Gift Cards purchased on or after the effective date of the change. Gift Cards purchased prior to the change will continue to be governed by the Gift Card Terms in effect at the time of their purchase, except where required otherwise by law.

12.3. It is the responsibility of the Gift Card holder to review these Gift Card Terms periodically.

13. Liability

13.1. To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with a Gift Card is limited to the value of the Gift Card itself.

13.2. To the maximum extent permitted by law, we will not be liable for any indirect, consequential, special, or incidental loss or damage arising from or in connection with the purchase, redemption, use, or inability to use a Gift Card, including loss of profit, loss of opportunity, loss of goodwill, or loss of data.

13.3. Nothing in these Gift Card Terms excludes, restricts, or modifies any rights or remedies that you may have under the Australian Consumer Law or any other applicable law that cannot be lawfully excluded, restricted, or modified.

14. Insolvency and Cessation of Trading

14.1. In the unlikely event that JJAK Pty Ltd t/a Stardate Candles ceases trading, becomes insolvent, enters into administration or liquidation, or is otherwise unable to continue operating the Website, Gift Cards may not be redeemable in whole or in part.

14.2. In the event of insolvency, Gift Card holders may become unsecured creditors of the company under Australian insolvency law. Recovery in such circumstances is not guaranteed.

14.3. Stardate Candles does not provide insurance, indemnity, or guarantee against the risk of insolvency or cessation of trading.

15. Privacy

15.1. Personal information collected in connection with the purchase, delivery, and redemption of Gift Cards is handled in accordance with our Privacy Policy, available on our Website.

15.2. By purchasing a Gift Card, the purchaser acknowledges that recipient details (where provided) will be used for the purpose of delivering the Gift Card and any associated communications.

16. Governing Law and Jurisdiction

16.1. These Gift Card Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia.

16.2. Any dispute arising out of or in connection with these Gift Card Terms is subject to the exclusive jurisdiction of the courts of Victoria, Australia, and any courts entitled to hear appeals from those courts.

17. Severability

17.1. If any provision of these Gift Card Terms is held to be invalid, void, or unenforceable, that provision will be severed to the extent necessary, and the remaining provisions will continue in full force and effect.
